Welcome to Gentle Goods Co.!

The terms “we,” “us” and “our” refer to Gentle Goods Co. Gentle Goods Co. operates this online store and website, including the related information, content, features, tools, products and services offered through it (collectively, the “Services”).

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services.

By visiting our website, placing an order or otherwise using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, please do not access or use the Services.

1. Eligibility and Accounts

By using the Services, you confirm that you are at least the age of majority in your place of residence or that you have the permission and supervision of a parent or legal guardian.

You may be asked to provide information including your email address, billing details, payment details and delivery information. You agree that all information you provide is accurate, current and complete and that you are authorised to provide and use that information.

If you create an account, you are responsible for keeping your login credentials secure and for activity conducted through your account. You must notify us promptly if you believe your account has been accessed without permission.

You may not sell, transfer, assign or license your account to another person.

2. Products and Product Information

We make reasonable efforts to describe and display our products accurately. However, colours and appearance may vary depending on your screen, device settings and lighting conditions.

Squishies may also have minor variations resulting from their materials and manufacturing process, including differences in colour, shape, painting, scent, texture, softness and rising speed. Small air bubbles, surface marks, wrinkles or slight variations may occur and will not necessarily constitute defects.

Product images are provided for reference. Unless expressly stated otherwise, accessories, decorations and background objects shown in product photographs are not included.

We may change product descriptions, prices or availability and may discontinue a product without notice. We may also limit the quantity available to an individual, household, geographic area or order where reasonably necessary.

Nothing in this section excludes any rights you may have under applicable law when a product does not conform to the sale contract.

3. Product Use and Safety

Our products are intended to be used only for their stated purpose and in accordance with any instructions, age recommendations or warnings displayed on the product, packaging or website.

Squishies are not food and must not be eaten, bitten or placed in the mouth. Some products or packaging may contain small parts that present a choking hazard.

Children should use products only when suitable for their age and under appropriate adult supervision. Customers are responsible for checking the product’s age guidance and suitability before allowing a child to use it.

Customers with allergies, sensitive skin or fragrance sensitivities should review the available product information and contact us before purchasing if they have concerns. Use must stop immediately if irritation or another adverse reaction occurs.

Products should be kept away from heat, flames, water, sharp objects and pets. Pulling, twisting, overstretching or puncturing a squishy may cause permanent damage.

4. Orders and Acceptance

Submitting an order constitutes an offer to purchase the products in your cart. An automated order acknowledgement does not necessarily mean that we have accepted your order.

An order is accepted when we confirm it for fulfilment or dispatch, subject to successful payment processing and product availability.

Please review your products, quantities, delivery address and contact information carefully before submitting your order. We may be unable to cancel or amend an order after fulfilment has started.

We may refuse, limit or cancel an order where reasonably necessary, including where:

A product is unavailable;
Payment cannot be authorised;
Product or pricing information contains a material error;
We reasonably suspect fraud, misuse or unauthorised resale;
The delivery information is incomplete or invalid; or
Accepting the order would breach applicable law.

If we cancel an order after payment has been received, we will refund the affected amount to the original payment method. We will attempt to notify you using the contact details supplied with your order.

Purchases are also subject to our Return and Refund Policy.

5. Prices, Payment and Billing

Unless stated otherwise, prices displayed on our store are in Singapore dollars.

Prices, discounts and promotions may change without notice. The price applicable to your order will generally be the price displayed when the order is submitted, subject to the correction of genuine errors.

Delivery charges and any applicable taxes or fees will be displayed at checkout where possible.

You agree to provide current, complete and accurate payment, billing and account information. You confirm that you are authorised to use the payment method submitted with your order.

Promotions may be governed by additional conditions. If specific promotion conditions conflict with these Terms, the promotion conditions will apply to that promotion.

Discount codes cannot be exchanged for cash and may not be combined unless expressly stated. We may cancel or refuse discounts obtained through fraud, error, misuse or unauthorised distribution.

6. Shipping and Delivery

We currently deliver only within Singapore. Any future availability of international shipping will be announced on our website or official social-media channels.

Processing and delivery periods are estimates and are not guaranteed. Delays may occur because of courier operations, severe weather, public holidays, high order volumes or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. If an incorrect or incomplete address causes a parcel to be delayed, returned or delivered incorrectly, additional redelivery charges may apply.

Nothing in this section limits any responsibility that cannot lawfully be excluded.

7. Returns, Refunds and Order Changes

Returns, refunds, replacements, cancellations and order changes are governed by our Return and Refund Policy.

We do not generally accept returns or exchanges solely because of a change of mind. However, this does not affect any rights or remedies available for products that are defective, incorrect or do not conform to the sale contract under applicable Singapore law.

Gentle Goods Co.’s name, logo, product names, designs and slogans may be trademarks or other protected brand assets. No licence or right to use them is granted except as expressly stated in these Terms.

Shopify’s name, logo, products and services belong to Shopify or its licensors. Other names and marks displayed through the Services belong to their respective owners.

9. Optional and Third-Party Tools

We may provide access to tools or features supplied by third parties. We do not necessarily control, monitor or endorse those tools.

Third-party tools are provided subject to their respective providers’ terms and policies. Your use of them is at your own discretion and risk. You should review the relevant provider’s terms before using a third-party service.

Any new features or tools added to our store may form part of the Services and will be subject to these Terms.

10. Third-Party Links

The Services may contain links to websites, content or services operated by third parties.

We are not responsible for examining or guaranteeing the accuracy, availability, security or practices of third-party websites. If you leave our website to access a third-party service, you do so at your own discretion.

Purchases made directly from a third party are governed by that third party’s terms and policies. Questions or complaints about third-party products or services should be directed to the relevant provider.

11. Relationship with Shopify

Gentle Goods Co. is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our store are made directly from Gentle Goods Co.

Shopify is not the seller of the products offered by Gentle Goods Co. and is not responsible for the fulfilment of your order or the products you purchase from us.

To the fullest extent permitted by applicable law, you agree that Shopify and its affiliates will not be responsible for claims, loss or damage arising from a purchase made directly from Gentle Goods Co.

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because Shopify hosts our store, Shopify may collect and process information relating to your access to and use of the Services. Certain information may also be processed according to Shopify’s Privacy Policy.

Information may be transmitted to Shopify and other service providers, including providers located outside Singapore, where necessary to operate our store, process payments, fulfil orders, prevent fraud and provide the Services.

It does not contain malware or harmful code.

You grant Gentle Goods Co. a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display the Feedback for operating, improving and promoting the Services.

We are not required to keep Feedback confidential, pay for it or respond to it. We may moderate or remove Feedback that we reasonably believe breaches these Terms or applicable law.

You remain responsible for the content you submit.

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery charges, transit times or availability.

We may correct genuine errors and update information at any time. If a material error affects an order already submitted, we may contact you with the corrected information or cancel and refund the affected order.

Nothing in this section allows us to misrepresent a product or engage in an unfair practice contrary to applicable law.

No provision of these Terms excludes warranties, guarantees, rights or remedies that cannot lawfully be excluded, including applicable consumer rights.

To the extent permitted by applicable law, you agree to indemnify Gentle Goods Co., Shopify and their respective service providers, personnel and affiliates against third-party claims, losses and reasonable costs arising directly from:

Your infringement of another person’s rights; or
Content you submit through the Services.

This section does not require you to indemnify us for loss caused by our own breach, negligence or unlawful conduct.
